On Friday, March 5, Governor Pritzker extended the eviction moratorium to April 3. The governor signed executive order 2021-05, which both extended the moratorium and also made one additional change to the procedures for evictions.
The new order states that if, after the filing of an eviction action, a tenant delivers an Illinois Tenant Declaration to the landlord, the landlord may only continue with the eviction if the tenant:
- Poses a direct threat to the health and safety of other tenants, or
- Is an immediate and severe risk to the property.
This clarification allows emergency evictions to continue even if a tenant is a “covered person” under the executive order.
