Take Action: Tell Legislators to Oppose Source of Income Mandates

We need you to take immediate, quick action to avoid source of income mandates for all rental housing providers being considered by the Senate as soon as this week.

TAKE ONE MINUTE TO TELL YOUR ELECTED OFFICIALS YOU OPPOSE HOUSE BILL 2775.

HB2775 would mandate all rental housing providers to participate in any local, state, federal or private subsidy or assistance program and comply with the requirements and restrictions of those programs, if an applying tenant qualifies for those programs. The bill also establishes an “affirmative defense” to an eviction if the tenant “would have” qualified for housing assistance; however, there is no way of knowing that definitively. If passed, the bill would:
  • Make discrimination based on a person’s “source of income” a violation of the Illinois Human Rights Act, and therefore a violation of the Illinois Real Estate License Act.
  • Mean “income” could be ANY local, state, federal, or private housing assistance. It’s unknown just how many programs this could apply to.
  • Mandate the Housing Choice Voucher Program would:
    • Force landlords to use HUD–dictated lease.
    • Subject landlords to “at-will” inspections.
    • Provide new rules regarding rent increases.
    • Further erode the rental housing market.
  • Impose unknown and potentially unreasonable requirements in other now-required local, state, federal and private programs.
